Criminal Injury - assaulted playing sport

Here is a case study of a victim assaulted whilst playing an organised game of rugby

The victim here was a rugby player who competed at a very high level. He was attacked whilst playing against a lower ranked local team in a cup competition.

On the opposition was a player who he did not know and had not encountered previously on the field of play, struck a blow to his face that broke his jaw.

The incident occurred off the ball and was deemed by witnesses to be unprovoked and completely unsporting. Despite the fact that the claimant was playing a physical sport, the injuries suffered were solely as a result of malicious wounding and nothing at all to do with the general rough and tumble of a rugby match.

The police pressed charges against the assailant following the cooperation provided by the victim and the witnesses.

Football fans assault man walking down a street

The claimant was walking down a road when confronted by a group of football fans.

Because he wasn't wearing a scarf he was accused of being a rival fan and then assaulted.

Here is a case study concerning a victim who was assaulted in the street

The claimant in this case was walking down a busy high street when he was singled out by a group of football fans.

They began to verbally abuse him and wanted to know which team he supported. Despite having no football scarf or strip to identify him he was accused of being a supporter of a rival team.

They then surrounded him in the middle of a busy shopping street and carried out a vicious beating. The assault resulted in a broken wrist, severe bruising and concussion.

The claimant had no recollection of the events that led to the assault.

The case was immediately reported to the police by a passer by and an ambulance was called to attend the injured party. With our help he was awarded £3700 in criminal injuries compensation form the CICA.

Mugged whilst on the phone

I was standing by my work vehicle talking on my mobile phone and was approached by the assailant. The assailant tried to steal my phone and slashed my face with a knife. He then left the scene.

Attacked in a nightclub

I was in a night club with my fiancé and a couple of friends. We were having fun and dancing when some of the girls on the dance floor started to yell at us about being foreign. We ignored them because we knew it was not worth it to be bothered.

The girls I was with had put their handbags on the dance floor and were dancing around them. One of the girls who had shouted at us complained about the handbags even though there was plenty of space. We again ignored them but they became annoyed for no reason.

Three of the girls came up to my fiancée and began yelling at her. I was talking to one of the boys who was with the girls. I wanted him to stop them and take them away. As I was talking to him the girls started attacking my fiancée. I tried to get in between then them to separate them in a calm manner. Whilst standing there the girls shouted to the security for help.

I do not remember what happened after this as I was hit from behind and was unconscious for approximately 15 minutes. I woke up covered with blood. The club was almost empty except for staff members and the police who had arrived.

Men threw drink and then glass causing injury

Myself and a friend arrived at a bar on our way home from an event in North London. We had only had two drinks previous to this and we ordered two pints and chose a seat furthest from the bar near the window. When we chose this seat the two seats opposite were empty.

Sometime later two men sat in the empty seats. At first they chatted amongst themselves but 5-10 minutes later they initiated conversation with us.

We spoke with them for a few minutes but then we politely said we were having a catch up.

One of the men started asking why we didn’t want to speak to them and became aggressive in his tone. My friend at this point asked the bouncer to have a word with the two men and they appeared to leave.

Ten minutes later the men came back. One of them was angry and the other was trying to lead him away. The bouncer asked them to leave and a bartender asked us if we would like to move closer to the bar where they could keep an eye on things.

After being moved the angry man came back shouted something incomprehensible to my friend and threw a drink over her. Not seeing that the man had gone outside my friend made her way to the bouncer who was also outside. I followed to support her at which point another drink was poured over my friend.

The man then threw the glass at us where it shattered on the door frame and bounced back into my upper lip.

The man was arrested at the scene and I gave a statement. I was taken to hospital where I received 5 stitches.

Assaulted by youth outside a pub

I was outside the pub just after closing time when a youth ran up behind me and hit me over 3 times with a wine bottle, then two other youths began hitting me, I got knocked to the floor but managed to get up and fend them off and get away and rang an ambulance.
